  3. TERMS AND CONDITIONS

  5. USING THIS DISC INDICATES YOUR ACCEPTANCE OF THE TERMS AND CONDITIONS.  
  6.  
  7. OWNERSHIP OF MATERIALS AND PROPRIETARY RIGHTS -- MULTIMEDIA WORLD LIVE! is published by 
  8. PC World Communications, Inc., ("the Publisher") and is protected by copyright law.  The 
  9. individual programs and products included on the disc (the "Material") and all 
  10. documentation accompanying the disc are also protected by copyright law.  Many of the 
  11. Materials are owned by third parties (the "Third Party Authors") who have provided those 
  12. Materials to the Publisher for publication.  The Publisher makes no claim of ownership of 
  13. those Materials and has not verified the ownership or accuracy of any of those Materials.

  15. You are licensed to use the Material only pursuant to these terms and conditions and any 
  16. additional terms and conditions included on the disc with respect to the various Materials.  
  17. You may be permitted to copy all or part of certain Materials for your use.  However, 
  18. reproduction of any MULTIMEDIA WORLD LIVE! disc in its entirety is prohibited, and you must 
  19. include the copyright notices on each copy of any Material or portion thereof which you make.  
  20. You may use the  disc only on one computer at one time.
  21.  
  22. If a Material is designated as "Free Use", it means that you are granted a non-exclusive, 
  23. non-assignable, and non-transferable license to use the Material free of any additional usage 
  24. fee or licensing charge for personal, business or production use so long as the Material is 
  25. not used for commercial or resale purposes.  Any commercial use requires permission from the 
  26. author.
  27.  
  28. If a Material is designated as "Demo/Promo", it means that the Material is intended for 
  29. demonstration or review purposes only and is not to be used for any purpose other than 
  30. evaluation of the Material.

  32. If a Material is designated as "Shareware", it means that you are entitled to use that 
  33. Material on a trial basis only.  If your use of the Material exceeds the time period set 
  34. forth in the terms and conditions accompanying the Material, you are obligated to forward the 
  35. indicated Shareware payment to the author of the Material. 
  36.  
  37. Except as otherwise expressly permitted by these terms and conditions or any other terms and 
  38. conditions included on the  disc, you may not use, sublicense, rent, lease, sell, transfer, 
  39. disclose, publish, or copy the  disc, the Materials, or any related documentation.  
  40. The Publisher and the authors retain all rights and interests not expressly granted to you.

  42. RETURN POLICY -- If a  disc is found to be damaged or inoperable upon receipt, you may return 
  43. that disc to MULTIMEDIA WORLD LIVE! for a replacement disc, provided that the damaged or 
  44. inoperable disc is returned within 30 days following your receipt of that disc.  Return discs 
  45. to: MULTIMEDIA WORLD LIVE!, Metatec Corporation, 7001 Metatec Boulevard, Dublin, Ohio  43017. 
  46. This constitutes your sole remedy and the Publisher's sole obligation to you with 
  47. respect to any damaged or inoperable discs.

  49. NON-RECEIPT / MISSED DELIVERY -- In the event an issue does not arrive, replacement issues 
  50. will be sent at no charge provided the replacement request is received within 30 days of the 
  51. intended delivery date.  Replacement requests received past 30 days of the intended delivery 
  52. date may be subject to a charge.
  53.  
  54. SUBSCRIPTION CANCELLATION / REFUND POLICY -- Subscriptions may be canceled at any time, for 
  55. any reason.  Cancellation requests must be received 21 days prior to the desired date of 
  56. discontinuance in order to prevent additional charges.
  57.  
  58. Refunds will be issued for any issues not shipped or not in progress.  Issues may not be 
  59. returned for credit.
  60.  
  61. WARRANTY DISCLAIMER AND LIMITATION OF LIABILITY -- SUBJECT TO ANY WARRANTY OR DISCLAIMER MADE 
  62. BY ANY THIRD PARTY AUTHOR ON ITS OWN BEHALF, NEITHER THE PUBLISHER NOR ANY LICENSOR NOR ANY 
  63. THIRD PARTY AUTHOR MAKES ANY REPRESENTATIONS OR WARRANTIES, AND EACH HEREBY EXPRESSLY DISCLAIMS 
  64. ALL REPRESENTATIONS AND WARRANTIES, RELATING DIRECTLY OR INDIRECTLY TO MULTIMEDIA WORLD LIVE!, 
  65. THE MATERIALS, OR ANY RELATED DOCUMENTATION, WHETHER EXPRESS OR IMPLIED, ORAL OR WRITTEN, OR 
  66. ARISING BY USAGE OF TRADE OR COURSE OF DEALING OR PERFORMANCE, INCLUDING WITHOUT LIMITATION 
  67. ANY WARRANTIES OF ACCURACY, PERFORMANCE, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.  
  68. EACH USER OF A MATERIAL IS RESPONSIBLE FOR DETERMINING THE SUITABILITY OF THAT MATERIAL FOR 
  69. THAT USER'S PURPOSES.  Some jurisdictions do not allow the exclusion of implied warranties, 
  70. so the above exclusion may not apply to you.

  72. IN NO EVENT SHALL THE PUBLISHER, ITS LICENSORS OR ANY THIRD PARTY AUTHOR BE LIABLE FOR ANY 
  73. INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING 
  74. WITHOUT LIMITATION LOSS OF DATA, INFORMATION, OR PROFITS, EVEN IF INFORMED OF THE POSSIBILITY 
  75. OF ANY OF SUCH DAMAGES, AND WHETHER CLAIMED UNDER CONTRACT, WARRANTY, TORT, STRICT LIABILITY, 
  76. OR ANY OTHER LEGAL THEORY.  Some jurisdictions do not allow the limitation or exclusion of 
  77. incidental or consequential damages, so the above limitation or exclusion may not apply to 
  78. you.  The Third Party Authors are not employees or agents of the Publisher and have no 
  79. authority, express or implied, to make any representations or warranties or otherwise act on 
  80. behalf of the Publisher. The Publisher's licensor's liability to you for actual damages from 
  81. any cause whatsoever, and regardless of the form of the action (whether in contract, tort 
  82. (including negligence), product liability or otherwise), will be limited to $50.
